IN Aberdeenbased Fridge Freight (Fyvie) must wait until next June to find out what action Scottish Deputy Licensing Authority Ramsay Delgety plans to take against its licence following breaches of an environmental condition.

The company, based at Kintore, holds a licence for 50 vehicles and 35 trailers. Three neighbouring residents complained about nine occasions when the company was alleged to have failed to ensure that the refrigeration equipment of authorised vehicles was muffled by a baffler at the operating centre. Magistrates heard that new regulations concerning the temperature of food were coming into force in October. These would require food to be refrigerated for longer periods and could lead to the equipment being changed and the condition varied.

Deferring the decision, Dalgety said that seven of the complaints had been proved.

However, there had been no breaches of the condition since December and if there were no more between now and next June he was unlikely to take any action. By June the company should be in a position to put forward any necessary variation application.
