• A Dairy Crest milk tanker driver was unfairly dismissed after the company suspected him of pilfering derv, a Leeds industrial tribunal concluded last week.

The tribunal was told that a fellow driver had allegedly seen Robert Addyman putting a can of diesel fuel in the cab of his vehicle. The depot manager went to investigate half an hour later but found nothing. Addyman flatly denied taking any fuel, but the next day another driver went to see the depot manager and claimed he had seen Addyman taking fuel on other occasions. Addyman again denied taking fuel but the depot manager decided to dismiss him and that dismissal was upheld on appeal.

Following the dismissal, a further investigation was carried out and the fuel sheets of all of the depot's vehicles were examined. The company felt that alterations found on seven pages of the fuel sheets clearly pointed the finger at Addyman, and it argued that he had altered the records to cover the supply of a gallon of fuel on each of those days to himself.

Nonetheless a further investigation was carried out after Addyman's appeal against his dismissal was rejected which was said to suggest that there was doubt in the mind of the employer about the soundness of the decision to dismiss at the time that it was taken.
