Which of the following most accurately describes the problem?

• Two Scottish hauliers had their licences curtailed by the Scottish LA, Mr A. B. Birnie, when they appeared in Dumfries last week under Section 69 following a failure to keep records of maintenance for their vehicles.

Mr W. M. Craig of Kirkcudbright had a licence authorizing eight vehicles but only four were in use. Convictions for overloading and defective tyres were admitted. Mr Craig told the LA that his vehicles had been inspected regularly once a month by one garage until September or October last year when the firm went out of business. After that he had done the inspection himself and in January this year another firm had taken over the work. He was unable to produce records of inspections made.

A representative for Mr Craig said that when inspected by an examiner no GV9s were issued. Mr Craig now wanted to use six of the eight vehicles authorized. Mr Birnie decided to curtail the licence to six vehicles and to further suspend three of the vehicles for 10 weeks.

The second haulier, Mr T. G. McDonald, of Dalbeattie, admitted having three immediate and four delayed prohibitions during the past two years on vehicles covered by an 0 licence authorizing seven vehicles. Mr McDonald explained that his son was now going to take over the maintenance of the trucks and arrange for the keeping of inspection records.

The licence was curtailed to six vehicles and reduced to five for two months.
