AULIERS' liabilities when it is not possible A -I. to obtain signatories fOr goods have been engaging the attention of the National Federation of Fruit and Potato Trades Ltd. In its annual report to its conference at Southport, it says that in several cases hauliers have notified clients that liability will no longer be accepted for loss of flowers delivered when no signature of receipt is obtained, deliveries frequently being before markets opened.
Legal advice has. been obtained and wholesalers have been advised not to accept such notifications. RHA Conditions of Carriage provide adequate protection for hauliers, states the report and market hours constitute reasonable times for deliveries to be made when there are personnel to receive goods.
"Certain hauliers also drew the attention of members to the clause in the RHA Conditions regarding acceptance of goods within a reasonable time. Members were again advised to affirm that normal hours are the only reasonable times which can be accepted."
