Which of the following most accurately describes the problem?

A BRANDON, Suffolk, trader r-k appealed to the Tribunal against the refusal of the Eastern Area Deputy Licensing Authority to vary the conditions of his B licence. The Tribunal allowed him an amended licence.

Mr. Jack Butcher, of London Road, Brandon, asked the Authority last November to extend the licence to allow him to carrycoal and coke from the Midlands to within a 50-mile radius of Brandon Post Office. The appeal was opposed by the British Transport Commission.

Mr. M. D. Van Oss, for Butcher, told the Tribunal that his client was a timber and coal merchant with two vehicles, one on B licence and one on C licence. Mr. Butcher collected timber from the Forestry Commission, processed it himself, and took it to the Midlands for use ultimately by the Coal Board.

He then brought back coal for his own business, but as his requirements were relatively small, nearly half the return journeys were made with an empty lorry. If the appeal were allowed it would enable him to carry coal and coke for Mellonie and Goulder, Ltd., of Ipswich, coal merchants, who did most of their business through the railways.

Let Them Down There was, however, continued Mr. Van Oss, a certain amount of their coal which had to be picked up in the Midlands by road, so they had asked MY. Butcher to do this for them. They had tried to get hauliers in the East Midlands to fetch the coal, but for various reasons they had let the firm down.

Giving his decision, Sir Hubert Hull said the cases of both parties were nicely balanced. "But on the whole, we think the appellant should have his licence, though not in the form in which he asked for it."

The B licence was amended to allow Mr. Butcher to carry—" on return journeys after delivery of timber to the National Coal Board or their agents— coal for MeIlonie and Goulder, Limited, from the Midlands to places within a radius of 50 miles front Brandon Post Office."
