Lincoln fails to get own name on licence

10 Steven Lincoln, a director of the failed Lincoln Haulage (Houghton le Spring) has failed to get a new licence in his own name.
Lincoln had originally sought a licence for 40 vehicles and 30 trailers but amended his application to 15 vehicles and 10 trailers during a Newcastle upon Tyne public inquiry before North Eastern Licensing Authority Frederick Whalley.
He told the LA that the company had encountered financial difficulties when hit by the recession after replacing its fleet with new leased Volvos. Initially, the bank had increased the company's overdraft facilities. However, the bank's attitude hardened and a receiver was appointed.
Asked about vehicle excise duty problems, Lincoln said cheques had been signed in good

faith, but the overdraft had been on the limit. There were three occasions when vehicles were not taxed, and these were due to errors.
Lincoln said that he had agreed with the receiver that he could continue to operate under the company's licence after taking counsel's advice; eight vehicles had been operated since the company was wound up.
After examining counsel's opinion, Whalley said there was nothing that suggested that Steven Lincoln was entitled to continue operating as an individual after the company had gone into liquidation.
Whalley contacted the administrative receiver who said that he had not given authority of any kind for Steven Lincoln to operate vehicles in his own name.
In the circumstances, Whalley was not satisfied Steven Lincoln met the requirement to be of good repute.
