Tipper company fined more than E2,000
A TIPPER operator has been ordered to pay £2,100 in fines and costs after pleading guilty to drivers' hours and tachograph offences as well as using an unauthorised operating centre Tideswell-based P S Roberts Haulage had pleaded guilty before Buxton Magistrates to use of an unauthorised centre in Bollington, using vehicles when drivers had broken drivers' hours rules, and permitting a driver to make false tachograph records.
Prosecuting for Vosa, John Heaton said the changes in drivers' hours rules relating to the taking of breaks and `off-road driving' counting as driving affected quarry operators particularly. In this case, the company had continued to operate under the old regime for commercial advantage, and to the detriment of road safety.
There was also a commercial advantage to the parking of one vehicle at Bollington rather than at the operating base near Tideswell.
Managing director Paul Roberts said that the new rules had made a serious financial impact.
He had given the operation a few months, but it was difficult to make it pay. He couldn't comply with the regulations and still continue to make a profit.
The biggest problem the company had, though, was with the new 4.5 hour rule. Also, he denied giving driver Keith Higginbottom permission to use a false name on his tacho charts.
The magistrates issued a fine of £1,700 and ordered it to pay £400 prosecution costs.
