• by Mike Jewell Three Greater Manchesterbased subbies who were caught running their trucks on kerosene have been hauled in front of North Western Traffic Commissioner Beverley Bell.

The hauliers, who worked for parcels and logistics firm TNT, have had to pay back duty and penalties of over 2100,000 apiece and could lose their Operators Licences.

Mark Kendrew, trading as Mark Kendrew Transport, of Rochdale; Martin Headley, trading as Martin Headley Transport, of Manchester; John Headley, trading as John Headley Transport, of Bury; and Headley Transport of Manchester, of which Martin Headley was a director, were called before the TC at a St Helens disciplinary Inquiry. In addition, Mark Kendrew was seeking an additional six vehicles and Bell was also considering the repute of transport managers Susan Headley and Steve Burdakay.

For the operators,

Jonathan Backhouse said that the three men had all admitted misusing kerosene In their diesel, and the use of unauthorised vehicles. They accepted that they had been caught "red handed" and had immediately indicated to Customs the extent of what had gone on.

Mark Kendrew said that Customs had seized six of his vehicles in August 2001, and was unable to produce tachograph records to the VI as Customs had taken them.

Despite their eventual return, he said he no longer possessed them as he only had to keep tachograph records for 12 months. He had no knowledge of tachographs

being tampered with and had no worries over drivers' hours as they were only doing 2.5hour journeys.

Admitting that he had used some vehicles Illegally during the period of kerosene use, Kendrew said he had not used them all the time.

He had done it to keep customers happy as jobs came along. He intended to "go straight" now, and was therefore seeking an increase In licence authorisation.

Susan Headley said that though she was nominated as one of two CPC holders on Kendrew's licence, she had only been responsible for his International operations, which had now ceased.

Burdakay, who is an operations manager employed by TNT, said that they were aware that he was John Headley's CPC holder. He had become his transport manager after the period of the misuse of kerosene.

The hearing was adjourned until a later date.
