Two brothers have been ordered to pay £1,700 in fines and costs for a series of offences including the falsification of tachograph records.

Mark Tilbury of Ilford, pleaded guilty before Eastbury magistrates to five offences of knowingly falsifying a tachograph record, five of driving an HGV without a licence and five of using an HGV without insurance.

Robert Tilbury, of Chelmsford, pleaded guilty to causing his brother to make false tachograph records, permitting him to drive the vehicle without a driving licence and without insurance, and to one offence of using a trailer without a test certificate.

When an artic being driven by Mark Tilbury was stopped at a roadside check it was found that his tachograph records bore a false name and his details did not appear on the DVLA database. He told a traffic examiner that he had been using a false name on the tachograph records to hide the fact that he was driving without the required driving licence. He claimed that he was working for his brother Robert who knew the full facts.

When Robert Tilbury was interviewed he admitted this. However, Jeremy Fear, representing the brothers, said that Robert Tilbury did not realise that because his brother did not have a driving licence the insurance was invalid, It was not delib

erate and the brothers had acted out of desperation due to difficult business circumstances. They had several creditors and were having to make payments to a former partner.

The magistrates fined each brother £600 with £250 costs and disqualified them from driving for six months,
