Which of the following most accurately describes the problem?

• British hauliers will not, after all, have to pay the threatened tax for using German roads. The controversial tax was due to start on 1 July but was suspended pending a hearing before the European Court in Luxembourg (CM 511 July).

Now the European Commission has won its case and the injunction is permanent.

Germany is expected to appeal but this is unlikely to happen before 17 September.

Meanwhile, foreign hauliers are able to travel through Germany without paying the tax, but ironically German hauliers still have to pay up and then claim a rebate — which is not for the full amount of the tax.
