Endorsement of the driving licence is obligatory in all offences against the drinking and driving laws but magistrates may use their discretion about disqualification in three instances. These are, offences involving Section 5(2) of the Road Traffic Act 1972, being in charge of a vehicle when unfit through drink or drugs; Section 6(2) involving being in charge of a vehicle with blood alcohol above the prescribed limit; and in certain circumstances when the offence is failing to provide a specimen.
