The claim was due to be ruled on by the National Industrial Relations Court later this month.

In June the Union was granted a four week adjournment of the hearing when it complained that Craddock Brothers had changed the basis of their claim. The firm's counsel, Mr Richard Yorke, QC, then hinted that the claim might be withdrawn.

Like the related case by Heatons Transport '(St. Helens) Ltd — who are understood to be intending to press ahead with their £10,000 compensation claim against the Transport Union — it arose out of the containerisation dispute in the docks.
