Which of the following most accurately describes the problem?

AN appeal by Messrs. J. W. [(itch in and Sons against a decision of the Yorkshire Licensing Authority, refusing certain modifications when granting a licence to continue to operate a group of excursions and tours from Bradford. has been dismissed with costs by the Minister of Transport.

Recommending this course of action, Mr. E. C. P. Lascelles, a Ministry inspector, said that he could not agree with the suggestion that because the appellants had built up a body of regular customers who wished to travel in their vehicles rather than in ehose.of another operator, it followed that additional facilities should be granted.

The need for extra facilities for any operator, he continued, had to be determined by taking into account the whole of the existing road and rail facilities. The Licensing Authority had consideeed the existing excursions and tours and there was nothing to suggest that material evidence had been disregarded. Respondents in this case were the Railway Executive and Wallace Arnold Tours, Ltd.
