Which of the following most accurately describes the problem?

FIVE drivers formerly employed by Nationwide Transport Ltd, Cardiff, were awarded extra payment for unfair dismissal at an industrial tribunal.

But seven other ex-Nationwide drivers had their applications for extra payments turned down.

The 12 drivers accepted redundancy payments for termination of their employment between May 13 and May 28.

The hearing was conducted in two parts; the first involved five men made redundant on May 13; the second was confined to seven drivers who terminated their employment on May 28.

Tribunal chairman E. D. B. Powell, referring to the first five redundancies, said the question revolved in the manner of handling the redundancy and the consultations seemed hasty.

"I think too little time was allowed. This was headlong haste and three or four days was simply not enough time for the men; consultations should have begun sooner.

"There was nothing to prevent the board having discussions with the men, weeks before.

"We think, in view of the past history, two weeks would have been a reasonable time and they should have been given until May 27 to make up their minds. Dismissals were premature", Mr Powell added.

The five men were awarded two weeks' pay as compensation — an average of taken over the last 12 weeks of their employment.

Referring to the seven redundancies which took place on May 28 Mr Powell said that, although several wage proposals were offered, all were rejected.

The tank is a standard Whale vacuum-effluent model of 4.000 gal ( 1 8 , 6 0 litres) evacuated by a Drum Engineering Gemini 400 exhauster with a swept volume 01 360cfm (612m3/hr). "No other means could be found to reduce losses and no real progress could be made. A last attempt was made on May 30 and failed. On May 28, the men were given a penultimate warning of redundancy and we do not consider this an unreasonable decision."
