Which of the following most accurately describes the problem?

A SUBCONTRACTOR, who took freight forwarding firm Centurian Systems to court over an unpaid £2,000 bill, fears he may never see the money because it appears to have ceased trading.

Ridgeway Storage and Distribution were forced to seek legal action after the Bridgewaterbased firm failed to settle its debts. These date back to work carried out on behalf of Somerset haulage firm UK Forwarding,whose directors —Tony Payne and Simon Nutt — were also directors of Centurian and a Devon-based parcel and pallet business, Atlas Shipping (CM 21 August). UK Forwarding ran up debts in excess of £250,000 at the beginning of the year and has now effectively ceased trading.

The court rejected Centurian's defence that it was unconnected with haulage or the invoice and a judgment has now been made demanding that it settle the bill. However, it seems the company has stopped trading. It failed to respond to any of the deadlines imposed on it by the court, it no longer has a phone line and its offices are sporting a 'To Let' sign.

Inkley says: "I am tempted to talk to our company solicitor and see if it's worth pursuing Atlas. Otherwise we are going nowhere."

But Tony Payne, ex-director of UK Forwarding and Centurian and now director for Atlas Shipping says 'Ilkley does not stand a chance.

"I am no longer anything to do with [Centurian]. It's got nothing to do with me."

Payne says he has not heard from Nutt for some time and refuses to comment further on the situation. Nutt was unavailable for comment.
