HAULIERS NOT only need to check their vehicles for illegal innnigrants when entering the UK, but must be able to prove that they have carried out the checks, says leading transport lawyer Tim CuIpin.

Culpin, partner in the transport team at Chester solicitor Aaron & Partners, has this week issued his clients with comprehensive advice on how to best avoid harsh penalties if illegal immigrants are brought in unknowingly.

Cu!pin's advice, based both on government rules and how those rules have been interpreted by the courts, even suggests that drivers not only check their trucks every time they stop, but obtain the signature and address of a witness who has seen them doing so. He acknowledges that carrying out all the checks presents many drivers with huge practical difficulties, but suggests that drivers may act as witnesses for one another.

He adds that if drivers are not present when their trucks are loaded they should ensure that the consignor completes and signs the relevant part of the form. If consignors refuse, the driver should note this on the form and again, if possible, find a witness.
