• Phillips Tankers (Bulk Powders) Manchester, two of its directors and six drivers have appeared before Salford magistrates on 105 charges involving excessive hours, the falsification of tachograph charts, and the operation of untaxed vehicles.
The company admitted eight offences of using vehicles without an excise licence, but denied two similar offences, five offences of failing to produce tachograph records, 12 of permitting drivers to make false entries on tachograph charts, two of permitting drivers to fail to use tachographs, and 20 of permitting drivers to drive excessive hours and take insufficient rest.
Director Peter Phillips denied 10 offences of aiding and abetting the company to use untaxed vehicles and five of permitting drivers to falsify tachograph charts. Director Neil Lightfoot denied seven off ences of permitting drivers to falsify charts.
Drivers Graham Barnes, James Harriman and David Barclay each admitted two hours offences. Driver John Longrigg admitted two offences of falsifying charts and three offences of taking insufficent rest. Driver Roger Bache admitted seven offences of falsifying charts and six hours offences but denied one offence of failing to use a tachograph. Driver Alistair Robb admitted three offences of falsifying charts and six hours offences.
Prosecuting, Bhaskar Choudhury said that in October and November 1988 the company had been operating 10 38tonne artics. After examining weight tickets at Fidler's Ferry Power Station, Greater Manchester police requested tachograph charts. An examination of the charts revealed that a large number of charts were missing.
The magistrates adjourned the case until June.
