Which of the following most accurately describes the problem?

• Scottish, English and Welsh Wool Growers Ltd., of Paisley, had its single C licence vehicle suspended for two weeks at Glasgow on July 11 when called to show cause under Section 178(1B). Donald Cooper, managing director, appeared for the firm and outlined the servicing arrangements handled by an outside garage. He presented invoices to show expenditure of £400 over a short period of time. It was accepted that the faults did exist and that some of them could be dangerous.

The company had now gone on to a more rigorous system of checking for defects. It was claimed on behalf of the firm that the prohibition had not resulted from wilfulness and that it had a clean record otherwise.

Mr A. B. Birnie, the Scottish LA, said this was a firm with one vehicle on C licence with one prohibition; they admitted that the faults were bad and he would say that there was danger. All that was being done was to rely on drivers.
