LAST September, Pointer's Transport Services, Ltd., Norwich, was convicted of a breach of the conditions of its A licence (as reported in "The Commercial Motor" on September 28, 1951). One of the comPany's vehicles had been found in Hereford, 30 miles beyond its permitted distance, and it was submitted in defence that the driver had been lent to the customer and that the job was being carried out legitimately under a C-hiring allowance.
Last week, an appeal by the company was heard by the Norwich Recorder. Mr. T. Springer, for the Eastern Licensing Authority, said that the lorry had not in fact been hired by the customer, but was used by Pointer's for the ordinary purposes of a haulage contractor. The Recorder said that it was his conclusion that the owners of thegoods had merely arranged with the company for the carriage of the goods under an ordinary contract.
He awarded £25 costs against Pointer's.
