A PARTNER in a Herefordshire haulage firm, who had continued to operate after a partnership was dissolved in October 2007, has succeeded in her bid for a licence in her own name — but for a lesser number than she applied for.

West Midlands Deputy Traffic Commissioner Jim Astle had been considering action against the licences held by Hereford-based Philip Davies and Lynda Stockton, who were trading as PDL, for 10 vehicles and 10 trailers; and Richard and Lynda Stockton, trading as Able Freight Services, for 10 vehicles and two trailers. he was also considering a bid for a new licence for 10 vehicles and 10 trailers by Lynda Stockton, who was trading as PDL.

The DTC said that the PDL partnership terminated in October 2007. Consequently, that licence became null and void.

Stockton revealed she had been in contact with the case worker in Leeds and nothing was said about the PDL licence ceasing to exist because the partnership had been dissolved. The pair also became confused because, in September, they received licence discs for the PDL partnership.

Vehicle examiner Alan Howells said that three immediate and two delayed prohibitions had been issued over the past five years. One vehicle took three attempts before the prohibition was cleared, and there was was an initial failure rate at annual test of 52.08%, compared with the national average figure of 34.3%.

Howells had informed Stockton in December that the PDL partnership licence was void.

Richard Stockton said they had spent a lot of money on issues related to maintenance, and that they had taken into account everything the vehicle examiner had told them.

Their operating area was rough and vehicles got knocked about. They were operating 17 vehicles and eight trailers.

Additionally, he gave a series of undertakings in relation to the future vehicle maintenance arrangements, The DTC revoked the original PDL licence, but granted the new licence in respect of five vehicles and two trailers.
