Which of the following most accurately describes the problem?

AN ESSEX TRUCK driver has been ordered to pay fines and costs of £500 for using a vehicle in a dangerous condition. Raymond Sinfield of Lodge Avenue, Dagenham, admitted the offence before the Enfield magistrates:he was fined £300 with £200 costs.

Anthony Ostrin, prosecuting for VOSA,said when Sinfield's Scania artic was stopped at a roadside check that the load sensing valve was found to be tied in the up position. "This vehicle had a braking system whereby on immediate application of the foot brake the tractor was likely to come to an immediate stop," he added. "The trailer, however, would be likely to continue, causing danger to other road users."

The magistrates accepted Sinfield's explanation that he did not know of the danger so they did not endorse his driving licence. However, they did express the view that in such circumstances a professional driver should have known the vehicle was dangerous.
