Which of the following most accurately describes the problem?

DRIVERS' HOURS and tachograph offences have cost a Surrey haulier £1,450 in fines and costs.

When Julian Artiss of Bransby Road, Chessington appeared before the Marylebone magistrates he pleaded guilty to two offences of taking insufficient daily rest, one of exceeding 4/2 hours driving without the required break and one of failing to complete his tachograph record. He was fined a total of £1,250 with £200 costs.

Anthony Ostrin, prosecuting for VOSA told the court that a traffic examiner visited the premises of The Artiss Haulage Cu and took possession of record sheets relating to Artiss. On examination, two charts showed that he had taken only 81/2 hours' daily rest out of the required 11. On another chart the analysis showed that the head of the tachograph equipment had been opened while the vehicle had been travelling at speed. The distance trace differed from the centre field readings by more than 20km.

A fourth chart showed that Artiss had been driving for five hours 40 minutes before taking a break. Astra Emir, appearing for Artiss, said that he was inexperienced and had only been driving for a short time. He had opened the head to see what hours he had done then attempted to close the head but it did not engage. With regard to the rest offences, she said that but for two movements during the course of a rest period the regulation would have been complied with. With regard to the break, he had taken breaks but they were not long enough.
