A KENT HAULIER received an eight-month prison sentence after running a business despite being bankrupt and banned from acting as a director.

Anthony Jones bought haulage firm Shropshire Container Services in 2009 and began operating out of a Folkestone base with him working as a director. This was despite Jones having been made bankrupt in 2006, which restricted him from acting as a director or having any involvement in the management of a business.

He had also failed to attend a meeting with the Official Receiver, as well as a court hearing in 2007, so his discharge was suspended.

Soon after the purchase, the firm, licenced to run six LGVs and six trailers, then attempted to set up a factoring agreement for its invoices.

However, during the due diligence undertaken by Bibby Financial Services, the company discovered Jones was still bankrupt.

His girlfriend Wilma Diblicek then agreed to become a director in his place, before resigning and being replaced by Jones, who then arranged a factoring agreement with Ashley Loan Finance.

However, Jones's secret emerged again during further due diligence and Ashley Loan Finance complained to the Official Receiver.

Judge Adele Williams at Canterbury Crown Court sentenced Jones to eight months, suspended for two years, and ordered him to do 150 hours' unpaid work and pay £500 in costs. Diblicek received a four-month sentence suspended for two years, a four-month curfew, and was ordered to pay £250 costs.

Shropshire Container Services' licence was revoked in 2011 for loss of repute, lack of appropriate financial standing and lack of professional competence.
