• Fines totalling £8,250 imposed on Draycote Continental Transport, its managing director Michael Kent, its former transport manager John Pratt and two of its drivers, following the use of "ghost drivers" (CM 9-15 July) have been reduced to £5,400 on appeal to Coventry Crown Court.

The company was fined a total of £3,050 on 11 offences of falsifying tachograph charts; one offence of failing to produce charts; one offence of failing to issue the correct charts to drivers and one offence of the incorrect use of tachographs. Judge Cole dismissed the company's appeal and ordered it to pay £400 costs.

He said the fines of £250 for each permit offences and £100, but for each of the other offences were proper.

Cole felt the magistrate had, in effect, been fining two people for the same thing when they fined Kent £250 on each of 11 offences of aiding and abetting the falsification of tachograph charts.

Pratt had fines of £250 on each of three offences of falsifying charts reduced to £150 and drivers Kenneth Dunkely — fined 2250 on each of three offences of falsification — and Clifford Bonham — fined £250 on each of five similar offences — had their fines reduced to £100 per offence.

Cole said that he had taken account of the means of the defendants. The company indicated they would have to be responsible for their own fines despite telling the magistrate it proposed meeting all the penalties itself.
