Which of the following most accurately describes the problem?

Minister of Transport has ordered rehearing of the application by son's Coaches (Overtown) Ltd. for cc to operate a stage carriage seretwecn Wishaw and Motherwell. as granted by the Scottish Traffic issioners. 9

observations of the Minister's or referred to certain defects in lich he suggests may have occurred exercise of the Commissioners' disin this case. In one instance, the issioners stated that they rejected us of passenger terminal evidence n Fast Coltness and North Forgeon the grounds that the evidence witnesses was not corroborated. vlinister agreed that to reject :e on the ground of lack of oration. when no corroboration in sense was required or necessary. was wrong in law. Nor in the other instance referred to by the inspector were the Commissioners right to decline to entertain the evidence submitted to them of the results of traffic censuses relating to the Meadowhead Road and Wishawhill areas. and to refuse to alloW the appellants to speak to it.

Again, it was for the Commissioners to decide in their discretion how much value to attach to any such evidence, but as the censuses covered different points from the joint census required by the Commissioners, the Minister was advised that the company was entitled. should it wish, to put them forward as evidence and speak to it. It appeared to the Minister that the Commissioners' original decision could on this account be challenged in law.
