Which of the following most accurately describes the problem?

• The Road Haulage Association has had to resubmit a proposed operating costs table to the Office of Fair Trading. If approved the cost table could help members ride out the recession.

The OFT has to be convinced that the RHA's document does not include an element of suggested rates — something the Restrictive Practices Act makes illegal.

"We had one proposal returned from the OFT and have had to send it back again," says the RHA. "It's a matter of when a cost becomes a rate. There is a dilemma as to what can go in."

The issue of a published costs guide was raised at the RHA's Tipcon conference (CM 2-8 May).
