Dawson, of Warwick Close, Walshaw in Bury, maintained that as he had been slowing down to meet stationary traffic at roadworks, a car had cut in front of him. Despite braking hard he had had no chance of stopping. Police evidence was that marks in the carriageway indicated that Dawson had been travelling at between 80km/ h (50mph) and 95km/h (59mph), which the prosecution claimed to be too fast.

The case was heard at Preston Crown Court.
