Which of the following most accurately describes the problem?

• It was definitely third time lucky for Terry Winch. After two failed attempts at his HGV Class I licence, he managed to pass with flying colours on the third try.

This success, however, was due to a long, hard-fought tribunal case, as Winch is deaf and dumb and was first refused a provisional HGV licence because of his disability.

His employer, British Telecom, decided to fight against the decision and presented its case at a tribunal to allow him to train as an HGV driver. The company succeeded, and Winch is now working as a lorry driver for British Telecom in south London.

Clive Constable, south London district transport manager for British Telecom, says: "Terry has always been a good driver for BT, so we wanted him to be allowed to take an HGV test. After seeing this case we hope other employers will give disabled people more of a chance."
