A BIRMINGHAM owneroperator had his 0 licence in respect of one vehicle revoked when he appeared before the deputy West Midland LA, Mr J. Shufflebotham, under Section 69 in Birmingham last week.

Mr C. L. Cheshire hadbeen called before the deputy LA as a result of a maintenance investigation earlier this year. Giving evidence on behalf of the DoE, Mr G. Sharp, vehicle examiner, said that on March 13 he visited Mr Cheshire and inspected his lorries. He discovered a total of six defects, including an inoperative handbrake, and issued an immediate prohibition notice. On inspecting maintenance records, the examiner discovered that there had been two to threemonth periods between inspections and that most of the records were incomplete.

Mr Shufflebotham pointed out that in June 1973, Mr Cheshire had appeared before the LA under Section 69 and had received a three-month licence suspension. In September, before getting his licence back, he was again called to court and given a stern warning as to the consequences of failing to meet the regulations.

In defence, Mr Cheshire said that he used the facilities at a local garage to carry out his own repair work and had cleared the GV9 within a matter of days.

The deputy LA said: "Despite these warnings you came back here with a vehicle that was found to be in a condition justifying an immediate prohibition."
