THE TRANSPORT Tribunal sitting in Edinburgh on March dismissed an appeal by W. J. Anderson, of Spean Bridge, against a decision of the Scottish Licensing Authority to impose a three-week suspension on its only vehicle and trailer.

Roderick MacKenzie appeared for the appellant and claimed that the drawing unit had been inspected monthly by the garage responsible but that a trailer used only intermittently had not been so examined.

When put in for test the trailer was given an immediate GV9. The appeal argued that the penalty — removal of all earning capacity for three weeks — was excessive.

There was only one GV9 in this case and on a trailer. If the penalty were confirmed it would have a serious effect on the business, especially in an area where it would be difficult, if not impossible, to hire alternative transport.

The tribunal dismissed the appeal and will give reasons in writing. The three week penalty will take effect from March 13.
