• Evidence had to be repeated by a vehicle examiner when the owner of an animal feedingstuffs haulage business brought before the North Western LA in Manchester for consideration under Section 69 said he was extremely hard of hearing and had not heard a word of what was going on. The LA, Mr C. Hodgson, told the owner — Mr E. R. Goodwin of E. Goodwin, Bickerton, nr Chester — to bring his chair next to the vehicle examiner.

The examiner, Mr D. A. Lees, said that in November last year, he had made a full appraisal of the vehicles, premises and equipment belonging to Mr Goodwin. There were no proper arrangements for maintenance and the only evidence that work had been carred out on the vehicles were some billheads produced by Mr Goodwin.

He had issued an immediate GV9 on one of the three vehicles. In June 1971, after another visit, he issued two delayed prohibitions. The premises, described as a small agricultural garage, proved to be an inadequate Nissen hut and only a few tools were available for repair work.

Mr Hodgson said the position was a most unsatisfactory one and if adequate reassurance could not be given he was seriously considering revoking the licence.

Mr Goodwin said plans had now been given the go-ahead to provide for an eight-vehicle building with pits and adequate repair and maintenance facilities.

Mr Hodgson told him in view of the fact that these steps were being taken he would not revoke the licence but Mr Goodwin must let the court know when the new premises were ready.

There was also an application for a further six vehicles but Mr Goodwin said he would not require these until October when the premises would be complete. Mr Hodgson said he would grant the application on condition that the building was ready.
