LANCASHIRE international haulier John Cowie faces action against his 0-licence after allegations he misled Beverley Bell. the North Western Traffic Commissioner.

Cowie holds a licence for five vehicles and two trailers trading as Cowie Transport. He said a vehicle he had driven to Gibraltar in December belonged to RI International, for whom he works as a subcontractor (CM 6 March).

However, he had registered the truck and it was taxed and insured by him. The allegedly false claim was made because it was towing an RI International trailer on a licence wrongly claimed to be held by Jack Duckworth, who also worked for RI International.

Duckworth worked for TNT, and Cowie invoiced TNT because he was an approved contractor and Duckworth was not. TNT was unaware the work it contracted to Cowie had been passed to Duckworth, who planned to purchase a truck from Cowie.

Duckworth had begged Cowie to do the Gibraltar job as he couldn't do it himself. Duckworth was interested in buying the truck that Cowie drove there, but the TC said records showed that the vehicle had never been specified on Duckworth's licence.

Traffic examiner Brian Newton said the charts for the Gibraltar trek showed that on the outward trip Cowie had driven for 13 hours 20 minutes without the required rest of eight hours 30 minutes.

There were no recordings on the chart for the return journey, with a note saying "forgot to put card in" and a sketchy manual record.

Cowie claimed it was impossible to comply with the drivers' hours rules in Italy, Spain, Bulgaria, Rumania, Hungary, Ukraine and Russia, saying if they stopped they could get robbed, gassed or shot.

The IC will announce her decision in writing.
