• A West Yorkshire firm of pallet recyclers has been warned that a second appearance at a disciplinary inquiry would have serious consequences. John and Stella Scully, trading as Tyersal Pallets, of Halifax, had been called before North Eastern Deputy Traffic Commissioner Brian Horner because of concern over their maintenance standards and the use of an unauthorised operating centre.

Stella Scully said that her sons had been taking vehicles home when they had finished late instead of leaving them at the operating centre.

DOT vehicle examiner Mark Millard said that in March he carried out a maintenance investigation following the issue of a prohibition for a significant maintenance failure. He inspected one vehicle and issued a defect notice. Since July 1994 two delayed and two immediate prohibitions had been issued; three of the prohibitions coming in January and February of this year. One of them was varied when the vehicle was produced for clearance.

The inspection records showed recurring defects and that the stated inspection period was not being followed, said Millard. Warning letters had been sent to the firm following unsatisfactory maintenance investigations in February 1995 and March 1996.

He was concerned that Mrs Scully's son-in-law had taken a vehicle out with a known dangerous defect. The firm no longer owned its declared operating centre at Heckmondwike and a new operating centre was being applied for at Birstall.

Homer cut the licence from four vehicles to three.
