TRAFFIC COMMISSIONER (TC) for Scotland Joan Aitken (pictured) has refused an application from Dundee-based Tayside Scaffolding for the return of a truck that was impounded for running without an 0-licence.

At a December public inquiry, the TC was told how Vosa officers had first stopped the boss of the business, Kerr Hay, in November 2011 while he was operating a two-axle rigid Iveco Cargo.

It was discovered that he did not hold a valid 0-licence for the vehicle.

In February 2012 an examiner twice saw the same vehicle on the road. The vehicle was being run without the required authority on both occasions.

Vosa then issued four letters to Hay, warning that his vehicle would be impounded if he did not apply for and obtain a the correct licence for it. Tayside Scaffolding subsequently applied for a licence, but this was refused when the business failed to meet some of the mandatory criteria.

Vosa officers detained the Iveco, which was being driven by Hay on the A9, for not having an 0-licence in November 2012.

The agency then impounded the vehicle, and Hay applied to the TC for its return.

However, in her written decision, TC Aitken said: "Vosa has produced compelling evidence for its decision to detain the vehicle.

"Continuing to operate after Vosa has warned of the need for an 0-licence can result in a vehicle being detained, and the hardship and inconvenience that Hay will now experience."
