E Overloading charges against Skipton haulier W&G Taylor were dismissed by Rochdale magistrates after the driver claimed he had been on his way to the dynamic weighbridge used in the check in order to check weigh his vehicle.
When the vehicle, an ERF 32 tonne artic loaded with scrap metal, was weighed there was a gross overload of • 6.8% and a second axle overload of 13.8%.
The driver, Robert Darwin, said that when he loaded the vehicle at Sheppard Waste Recovery in Milnrow he had checked it on the plate weighbridge at their premises and discovered a train weight overload.
He removed part of the load to get within the permitted train weight and was making for the nearest weighbridge to check his axle weights when he was stopped in a police check.
