Which of the following most accurately describes the problem?

One of my artics was stopped outside a port on its way to Spain via France.

When the driver left the depot he had picked up permits intended for a journey by a different vehicle to Austria through Germany. The examiner did not believe him and I have now received two summonses claiming that I was using the vehicle when permits were not on the vehicle for the journey to France and Spain.

I did not know such offences existed. Are they right?

A The charge relating to France is correct, but not the one relating to Spain.

Section 1(3) of the International Road Haulage Permits Act 1975, under which the charges are brought, makes it unlawful for a person to use a goods vehicle on a journey, to which regulations made under Section 1(1) apply, unless a permit is carried on the vehicle.
