BUS grant payments to -nunicipal operators have been restarted by the Department of Transport.

But the allocation to different operators has been arbitrarily decided by the Department without the agreement of the Association of District Councils, It is based on proposals made by the ADC earlier this year but modified to take account of payments made in 1976-77 on claims submitted before 1 April 1976.

Legal advice taken by the Transport Department after earlier threats of court action by the ADC, suggests that "approvements in principal" given for bus grant payments are in fact worthless bits of paper.

"Payment of the grant is voluntary and the normal principle is that the courts will not enforce a voluntary payment," states a letter to ADC secretary Stephen Rhodes from the DTp.
