• A B-licence variation application by Jiltsways Haulage Ltd, of London N3 was refused on Friday after the evidence of Mr David Bush, describing himself as the company's agent, showed that the conditions the company, required differed from those published in Applications and Decisions.

The published application was for a hiring allowance of two vehicles at 6+ tons in substitution for two at 5 tons, the conditions to be: "Excavated building, road-making materials, rubbish, scrap metal and solid fuel within 200 miles of Marylebone railway station". Mr Bush said he wished to amend this to one vehicle at 6.41 tons to be acquired, conditioned within 45 miles.

Mr A. Artemidies, company director, applied to Mr W. M. Levitt, Metropolitan deputy LA for an adjournment, but this was objected to by Mr K. Shiemann, for BRS Ltd, and Mr F. Crighton, for British Railways, both objecting to the application, and the adjournment was refused. Mr Artemidies said he had no customer witnesses present and the accounts figures were uncertified. "It seems to me you have had plenty of time," said Mr Levitt.

Mr Bush was asked by Mr Levitt if his accountant was a director of Jiltsways. Mr Bush said he was not and he would prefer to take that matter no further at public inquiry. Mr Shiemann said he was not prepared to accept uncertified figures, to which Mr Levitt added: "I am certainly not prepared to accept uncertified figures from this company."

Mr Shiemann then asked Mr Bush what position he held with Jiltsways. Mr Bush said he was the agent, paid on a percentage-of-profits basis. He agreed with Mr Levitt that he was not the contracts manager and that all the relevant forms he had signed stating that he was, were untrue.

Referring to the applicant's list of customers, Mr Shiemann asked Mr Bush if he had any financial interest in any of them. Mr Bush said he had not, but went on to say that one customer, Henry and Co (Groundworks) Ltd,, had been a client of his consultancy business (CM January 9) and that he was still a director of Garmere Transport, Ltd, although ,now taking no active part in it.
