Wynne in his report on the appeal of Brighton Corporation against the grant of a licence by the South-Eastern Commissioners to Thomas Tilling, Ltd., for this service.

HIving regard to the history of road services in Brighton and district, and the negotiations as to a merger, Sir Henry Wynne supportedthe views of the Commissioners in granting the application to the Tilling concern. Dismissing the appeal, the Minister concurs with Sir Henry's views.

So far as the extension of the service, to Saltdean is concerned, this point was not argued before the Commissioners, and, in their view, should be dealt with on an application for variation. Questions as to the route were considered, the corporation Objecting to buses in Madeira Road, preferring Marine Parade.

With this view Sir Henry Wynne was unable to agree, and no objection was found to the alternative route. The service was both necessary and desirable in the public interest.

Arising from the question of the corporation running its own services, an application was also made to the Minister under Section 91 of the Road Traffic Act, 1930, for an Order modifying or revoking a restriction on the running of passenger vehicles, imposed under Section 114 of the Brighton Corporation Act, 1931. This application was made to enable the authority to operate a service over a road outside the borough (in Hove).

The Minister has noted the submisa40 sions of counsel appearing for both corporations as to the interpretation which should be placed on Section 114. He stated that, had Sir Henry Wynne's recommendation been based upon the interpretation of the section in question, it might be found necessary to express an opinion on these points.

As, however, the recommendation was based on the merits of the case, comment was unnecessary, beyond pointing out that there does not seem to be anything in Section 91 of the Road Traffic Act, 1930, which in any way restricts the exercise of the Minister's power under that section to cases where there has been a change of circumstances since the passing of the local Act. The Minister, therefore, decided to make no Order in this case.

Bournemouth's last tram service was discontinued on April 8, when it was replaced by a trolleybus system.
