I T is within the discretion of a Licensing Authority to add to a road service licence facilities which are not sought, according to an appeal decision announced last week.
The Minister of Transport has rejected, in the main, the appeals of Barton Transport, Ltd.. and Mr. Harold V. Richmond, against the Eastern Licensing Authority's grant of permission to Mr. Herbert A. Harvey to run excursions and tours from Cottenham to Dover, for the Continent.
He has, however, made an Order on the Authority to delete from the licence a picking-up point at Histon.
After stating that he agreed with his inspector, Sir Robert Tolerton, that a limited licence was justified, the Minister goes on to say that notwithstanding that it did not appear in the respondent's application or notice of application, thc addition to the licence of the picking-up point was within the Authority's discretion.
He had, however, decided to order the deletion of the picking-up point because he did not feel that this instance represented a suitable exercise of that discretion.
The Minister pointed out that his decision should not be taken as prejudicing the position if the respondent were to seek to add the picking-up point to his licence in accordance with the relevant Regulations.

Ltd. The purchasers are Marshalls (East Africa), Ltd., Nairobi, and the vehicles involved are Otters and' Invincible four-wheeled and six-wheeled heavy-duty models.
