Which of the following most accurately describes the problem?

• Mercedes main dealer H & L Garages, of Scunthorpe, and the company's sales manager, Graham Precious, have been committed for trial at Grimsby Crown Court on charges alleging the deliberate registration of a lower than actual unladen weight for a number of light goods vehicles.

The company, of Brigg Road, Scunthorpe, is accused of eight offences of making false declarations in connection with applications for vehicle excise licences by declaring a false unladen weight, and one offence of cheating Her Majesty the Queen and the public revenue on drivers' dates between 18 June and 2 September, contrary to common law.

Precious, of 21 Church Avenue, Humberstone, near Grimsby, is accused of aiding and abetting the company to make false declarations, and of an identical common law offence of cheating the revenue.

Prosecuting for the North Eastern Traffic Area, Richard Hickmet asked leave of the Barton on Humber Magistrates to withdraw the common law offence against Precious. However, the magistrates felt the whole case ought to be dealt with by the Crown Court.
