Stowes' drivers win compensation claim

• Two truck drivers left their jobs with Frank Stowes when they became dissatisfied with their pay, following the company's takeover by Canute Haulage. Now they have been awarded over 23,000 compensation each for unfair dismissal by a Nottingham industrial tribunal.
The tribunal accepted that the two drivers, L Pond and P Morton, had been "constructively dismissed" and entitled to resign as a result of their employer's action.
Both men were long-serving employees, said the tribunal. No prior notice of the takeover was given to the workforce and following the takeover, the basis for calculating the drivers' wages was changed.
That change was never satisfactorily explained to the drivers, and the company's claim that the drivers earned more each week for less hours was disputed.
Both men feared they would be substantially worse off. Those fears were confirmed when Morton received less than he had calculated he was due in two succesive weeks and he complained to no avail. Both men left immediately.
Holding that they had been fully entitled to leave, the tribunal awarded Pond 2,395.20 compensation, and Morton £3,106.90.
