AN OPERATOR who allowed a driver to drive illegally on a New Zealand licence has received six penalty points and fines totalling £900.

Uxbridge Magistrates handed down the penalty to Greenford-based John McDaid for permitting one of his drivers to drive without a licence and without insurance. "A high duty of care is upon an employer to establish that goods vehicle drivers are properly licensed," they told him. He was lined £700 plus £200 costs and his licence endorsed with six penalty points.

Anthony Ostrin, prosecuting for VOSA, said the driver of a 17-tonne skip lorry belonging to McDaid produced a New Zealand driving licence when stopped in a roadside check. It did not allow him to drive an HGV in England and as a result any insurance covering the vehicle would be invalid. When interviewed McDaid had said the "girl in the office" inspected a copy of the driving licence. She thought the driver concerned had an entitlement to drive the vehicle and presumed everything was in order.

For McDaid, John Daley pointed out that he could neither read nor write and it was reasonable to delegate this enquiry to the girl in the office. She had telephoned the DVLA who had told her in general terms that such a licence would be valid.

In fining McDaid magistrates said they found his action in asking an office clerk to check the licence not sufficiently diligent. His difficulty with writing did not excuse that.
