• Eurohaul boss John Heads will not face trial for threatening to kill United Road Transport Union general-secretary David Higginbottom.

The Middlesbrough haulier, who also owns Auto Recovery Services, made the threat by phone after becoming incensed at a libellous article which appeared in URTU's magazine Wheels.

Higginbottom complained to the police and Heads was arrested on a charge of "threatening to kill". But Heads heard last week that the Criminal Prosecution Service had decided not to proceed with the prosecution. "I think they accepted that I was very cross, and excused me for blowing a gasket," says Heads.

Detective Inspector Peter Cunningham of Manchester Police says: "It was a dispute between two men in the same business. The CPS decided not to proceed because of a lack of evidence."
