Which of the following most accurately describes the problem?

• Planning problems have led to the licence of Cumbrianbased haulier Richard Johnston being renewed for seven vehicles and three trailers only (CM 4-10 July 1991).

Johnston, trading as R Johnston Construction, had applied to renew his licence for 15 vehicles and 20 trailers with operat ing centres at Bardsea and Linda! in Furness. There were environmental representations from six neighbouring residents against the proposed Bardsea operating centre.

For Johnston, Gary Hodgson told North Western Licensing Authority Martin Albu that he objected to South Lakeland District Council giving evidence, on the grounds that it had not objected or made representations. However, the LA said that he had invited the council to outline the planning history of the site.

The LA was told that planning enforcement action had been taken against the Linda' in Furness site, formerly derelict railway sidings, in October 1989.

Johnston's appeal against that notice was rejected in May 1989 and he was required to stop using the site as a haulage depot by August.

Hodgson argued that the LA was not concerned about the planning situation.

Granting Johnston permission to use the Bardsea site, but refusing authority for Lindal in Furness, Albu said that he had visited the latter and in his view it was perfectly suitable. He could not understand why planning permission had been refused. However, Johnston would be in breach of planning law if he continued to operate from the site and he did not feel he could grant authority for its use in such circumstances.
