The Tribunal concluded that Mr Chadwick's behaviour amounted to gross misconduct which would have justified dismissal without any previous warning.

It said it was clear from the evidence that Mr Chadwick was a good driver, but he had been warned previously about his attitude and refusal to do work. It was clear the company had been tolerant towards him in the past.

On this particular day he was given the opportunity of speaking to the managing director, but he still persisted in his refusal to take out the load except on terms that could not be permitted.

This was a matter that could undermine the authority of the company and they acted reasonably in dismissing Mr Chadwick.
