A DERBYSHIRE HAULIER has had his 0-licence revoked after North Western Traffic Commissioner Beverley Bell decided he was being manipulated by a father and son to enable them to continue in business.

A lire ton-based Alec Ridleâ– ,,, trading, as Ashlield Distribution, held a licence for live vehicles and four trailers.

Ridley's transport manager, John Murfin, had lost his repute when his own licence, in the name of JT Transport, was revoked in November 2004 by Deputy Traffic Commissioner Elizabeth Pencil.

Mullin had been a director of _IT Transport (Midlands), Midland Transport Services, Millennium Vehicle Services (Midlands) and SIM Logistics, all of which had either gone into liquidation or been dissolved.

I Us son Andrew had been involved with the Ashfie kJ Distribution business where he was responsible for safety inspections.

Vehicle examiner Colin Brown said Ridley had been operating six vehicles and nine trailers. One vehicle had been operated without a test certificate throughout 2006. There were no safety inspection records or defect reports in relation to the trailers and one vehicle. The vehicle inspection records had not been satisfactorily completed and a number were missing. No mileages had been entered, which brought the validity of the records into question, particularly as one of them had been dated New Year's Day.

Safety inspections had been carried out in-house by Andrew Murfin.A trailer given an immediate prohibition for brake defects had variation and refusal notices issued when it was twice produced for clearance.

Traffic examiner Caleb Moore said an examination of tachograph charts revealed distances that could not be accounted for and drivers driving for up to seven hours without taking the required breaks. The vehicles' livery showed Andrew Murfin's mobile number as a contact number rather than Ridley's.Documents relating to the premise's lease and a customer contract had been signed by Andrew Murfin.

There was confusion over who allocated work to drivers; Moore's impression was that the business was being run by Andrew Murfin.

The TC said she was satisfied that Andrew Murfin was the controlling interest, and that he had used the licence, aided by his father, to continue the operation of vehicles despite the liquidation of the various companies and the previous revocation order.

Quite simply, she concluded, the licence had been used to circumvent previous orders. The TC was also satisfied that there was no place in legitimate road haulage for John M urlin, either as a transport manager or an operator..
