Which of the following most accurately describes the problem?

A DRIVER for Crosville Motor Services Ltd, a member of the National Bus Company, was cleared of driving his bus without due care and attention and failing to give precedence to a pedestrian on a zebra crossing, when he appeared at Runcorn magistrates' court last week following an accident in which a 75-year-old man died.

Mr George Leece, of Cotton Road, Runcorn, admitted using a public service vehicle when the braking system was not kept in efficient working order. Crosville admitted permitting the vehicle to be used in an imperfect condition.

Mr G. Etherington, prosecuting, told the court that Mr Leece had been approaching a zebra crossing when he noticed a man about to use the crossing and applied the brakes, but the vehicle had not responded. The pedestrian was taken to Vspital, but died later. Mr J. Brimelow, representing Mr Leece and Crosville Motor Services, said that Crosville was most concerned about the results of the incident, but, in his opinion the system of' maintenance used by the company was "second to none".

Crosville Motor Services were fined £35 and their driver, Mr Leece, was given an absolute discharge.
