Which of the following most accurately describes the problem?

A CHANGING pattern in commerce r't was cited by a Buchan haulage contractor last week as " his reason for appearing before the Scottish Licensing Authority at Aberdeen for additional facilities.

Eric B. Christoffersen, Longhaven, Cruden Bay, painted out that the opening of new plant in Aberdeen for a large national agricultural supplies firm meant less haulage for him because farmers could now get their supplies direct. He had been forced •to find other 'work, which entailed longer journeys to South Scotland and parts of England, and he asked for an extended normal user to cover them.

Mr. Christoffersen, who agreed that previously he had been penalized for infringing his normal user, was challenged by Mr. David Brown, for British Railways, with again running outside his normal area. Mr. Christoffersen: "1 haven't had much chance, have 1? It is always punishment when you come here."

Mr. I. Townsend, Deputy Licensing Authority, said he had not sufficient evidence to justify a grant, but he was going to adjourn the case to give the applicant an opportunity to call further witnesses.

"If I refuse the application now," said Mr. Townsend, "Mr. Christoffersen will go away again under the impression that all one gets in this court is punishment and not justice. But if I grant a licence I will have to impose a penalty."
