• Wilton Contracts (London) has been refused a licence because South Eastern & Metropolitan Deputy LA John Stevenson does not believe sole director Anthony McCarthy is in control of the business_

Wilton, of Dreadnought Wharf, Greenwich, had applied for a new national licence for three vehicles and one trailer but the DLA suspected it was a "front" for Eugene O'Riordan.

His company, JB&M Motor Haulage, of the same address, lost its licence following convictions for fly tipping.

In September the hearing was adjourned to give McCarthy time to prove that £100,000 he said he invested in the company was his own money (CM 17-23 Sept). After hearing financial evidence in private at the company's request, Stevenson said that he was satisfied about McCarthy's financial involvement in the company.

But he noted that a £1,000 cheque for the deposit on a tipper had been signed by O'Riordan. Also, an application had been made for a London lorry ban permit for a tipper company which Margaret Reynolds, company secretary, had said Wilton was buying. The application was in the name of JB&M.

Stevenson said that his information was that JB&M had been struck off in July, but Reynolds denied this. JB&M was still working, she said.

Refusing the application, Stevenson said that at the previous hearing he had been told that McCarthy dealt with the outside work and Reynolds with the office work. He was entitled to lift the corporate veil".

McCarthy was the sole director but he was not satisfied that he directed or controlled the company. He believed that Reynolds, with others, controlled the day-to-day operation. As a result, he was not satisfied about the company's repute.
